The man found guilty of gaybashing Ritchie Dowrey at the Fountainhead Pub in Vancouver is appealing his six-year sentence.

Shawn Woodward is currently being held at the North Fraser Pretrial Centre in Port Coquitlam.

Dowrey lives in a care home because he can no longer live independently.

A provincial court judge convicted Woodward and designated his assault a hate crime on Nov 8, the second such designation to be granted in Vancouver in 2010.

Michael Kandola's attack on Jordan Smith was also designated a hate crime in April, when he was sentenced to 17 months in prison.

Kandola, too, filed a notice of appeal but, according to the BC Court of Appeal registry, that appeal was abandoned on Nov 2.

Woodward's appeal was filed on Nov 15 by lawyer Joel Whysall, who represented him at trial.

Woodward's appeal relies on four points.

First, that Judge Jocelyn Palmer placed more emphasis on the aggravating factor of bias, prejudice or hate than was warranted.

"I see no other possible explanation for Mr Woodward's behaviour than virulent homophobia," Palmer ruled in passing sentence.

Woodward had told the court that Dowrey offered to buy him a drink, touched him on the shoulder and later put his arm around him before grazing his thigh.

"He's a faggot. He deserved it. The faggot touched me. He deserved it," Woodward told multiple witnesses while being detained for police.

Whysall also says the judge placed unwarranted emphasis on Woodward's lack of credibility.

Palmer ruled Woodward embellished or adjusted his evidence at various times.

"I did not find Mr Woodward to be a credible witness," she said in her decision. "I did not believe his evidence.

"I find Mr Woodward is prepared to deny, deflect and dissemble."

The appeal also argues that the judge erred by unduly focusing on the nature of the injuries sustained rather than the nature of the assault.

Palmer said in her decision that medical evidence showed Dowrey sustained a skull fracture from the punch. Other injuries, which the court heard earlier, included a shifting of the brain and bleeding in the skull.

The fourth point of appeal is that the judge erred in not attributing enough credit to Woodward's lack of criminal history and the fact he was being sentenced to jail for the first time.

In sentencing proceedings, Palmer questioned Whysall for making a similar assertion.

She noted the court had already heard Woodward had a conviction for drunk driving and had been addicted to crack cocaine.

Disgusting people like this guy deserve 6-years and then some. May justice prevail and he stays in jail a long time. Oh...and do drop the soap.

This guy is unbelievable.
So man #1 breaks man #2's skull because man #2 made a pass at man #1 and he's straight. Man #1 then appeals his sentence because he feels that the judge overemphasized the bigotry that led him to commit this violent assault. "Well, yes, your Honour, I inflicted a serious brain injury on Mr. Downey because I hate gay men and he made a sexual advance towards me, but I feel you've placed too much weight on this fact when sentencing me." I didn't think six years was quite long enough when the sentence was handed down, and now I'm with Marc: buddy should get his jail time doubled. Our community doesn't need people like him on the streets.

Sad excuse... for a human being
If you live in Vancouver you know that the Fountainhead is a gay bar. So why would you go there if you gay people unless you want to start something and give yourself an excuse to attack somebody. This guy deserves far more than the six year sentence.

Sad day for Society
When was the last time you heard of a man pressing charges on a girl that slapped him for making a similar pass at her? I am not even from Van, and I know that Fountainhead is a gay bar, in the gay village, surrounded by pride flags... I sure hope that we do not let him plead ignorance, and let him get away with it... There are so many things wrong with this picture, I don't know where to start. Whether it is his first offence or not, he still seriously injured someone, when it was not warranted. A simple "no" was at it would have taken. Based on the article, it sounds like he would have had time between the shoulder touching, and arm around him to respond with some sore of let down...

Throw the Book at Him
This son of a bitch has a nerve appealing a justly applied sentence. He ruined the life of another human being and committed an act of pure evil. Let him appeal this charge if he wants to, but let's all make sure the judge who hears this case denies his appeal, based on the FACTS. This bastard deserves to rot in jail. That he would appeal his sentence just shows he is in no way repentant or sorry for his crimes. He deserves our condemnation and excoriation!!

Lucky bum, the sentence should have heavier. If I was in his shoes: I would just shut up and get better legal counsel. I only hope the judge will decline such outragous request.
