Six months in jail, 60 to 80 lashes and death by stoning is the potential fate that awaits a gay man who fled to Canada from Iran, where he faces sodomy charges.

Yaser (who requested his last name not be published) now faces deportation, after the Immigration Refugee Board (IRB) in Vancouver denied his refugee claim because it didn’t believe he was gay.

A federal court subsequently refused to review his case.

Yaser, 29, is now pursuing the only two options he has left: seeking a pre-removal risk assessment (PRA) to determine whether he’ll be in danger if sent back to Iran, and applying to remain in Canada on humanitarian and compassionate grounds.

Speaking to Xtra through a translator, Yaser says his attraction to men was “always there” but he only became familiar with the idea of being able to live as a gay man after he got to Canada.

Life in Iran was “simple, traditional” and “very controlled,” he says.

His attraction to men became a life–threatening matter after police disrupted a house party he was having with two other friends, who were having sex. Yaser escaped arrest, but his two friends were taken into custody. He later learned that he and his friends were charged with sodomy.

Three months later, Yaser fled Iran. He ended up in Vancouver where he was detained for 19 days before being released to prepare for his refugee hearing last September.

In denying Yaser refugee status, the IRB ruled the Iranian court documents weren’t genuine because they bore a court clerk’s seal rather than a judge’s seal, says Chris Morrissey of the Rainbow Refugee Committee.

The board also questioned why it took Yaser so long to leave Iran if he knew “as a gay man” that he was in danger, Morrissey says.

Moreover, the immigration minister’s representative at the hearing found Yaser’s inability to recognize the rainbow flag and Pride parades as gay cultural markers incredible.

Morrissey says that’s a very presumptuous judgment.

“Oftentimes, there’s an assumption on the part of board members that someone from another country, being gay or lesbian or trans, is equal to being gay, lesbian, trans here in Vancouver,” she notes.

“So for a board member not believing that Yaser is gay because he hadn’t participated in the 2008 Pride parade, [that] he should have known about the Pride parade, because of all the rainbow flags — if you’re living in a country like Iran there’s no such thing as a Pride parade and certainly they’re not flying rainbow flags,” Morrissey points out.

While she can’t speak to the specifics of Yaser’s case, IRB spokesperson Paula Faber says members receive specific training about handling refugee claims based on sexual orientation.

She says members are warned against stereotyping and made aware that claimants find it difficult to speak about what they’ve been through. They’re also coached in interview techniques and establishing claimant credibility.

Rainbow Refugee volunteer Sharalyn Jordan recently attended such a training session. She says there is no single litmus test to prove someone’s sexual orientation.

All refugee cases are complex, she says, especially sexual orientation cases.

“In no other kind of claim are people required to speak out about such intimate and stigmatized parts of themselves — I think that sets them apart,” Jordan says.

“They’re working to prove an identity or orientation that they have had to keep hidden in order to survive. So that creates all kinds of documentation problems, and also a real limit to the quality of information we have about country conditions around transphobic or homophobic persecution,” she explains.

“The best approach is to ask open-ended questions about people’s lives and listen for consistency and credibility.”

My Persian partner and I didn't attend Pride last year, or the year before, and care more about the Canadian flag than any others. I guess we're not gay. I'll have to tell him when he gets up.

Public Action Required!!
The gay community of Vancouver, indeed, the entire gay community of BC, should band together and raise funds to defend this man. He clearly has grounds to stay here, I don't know what the hell the IRB were thinking! Could it be that Jason Kenney, being a Tory, instructed immigration officials to deny this man's case on some idiological grounds? It's happened with the Tories before. Like I've always said: Tory is as Tory does! This case should also serve as a clarion call to gay people all across Canada: Vote the Tories out before they strip us of our rights. Support the liberals and the NDP next election!

Another fake refugee looking for a lifetime of free welfare, housing and health care at the expense of Canadians. How many European countries did he pass through before getting to gullible Canada. Thank god we have the conservatives in charge to set finally things on the right path.

Coming from such a repressed society as Iran its no wonder he didn't recognize the rainbow flag or attend the Pride parade, he's still probably riddles with internalized homophobia too for that matter, as most of us know growing up in a rabidly anti-gay environment does a lot of damage to a person's sense of self worth and it can take a long time to get over especially when he's also dealing with a refugee claim. It reminds me of those who were denied refugee status since they weren't gay enough and it was felt they could easily stay in the closet in their home country. The IRB needs to be changed, its not just a Con problem but I certainly don't expect it to get any better under the Cons, especially when they're appointing rabid and out spoken homophobes to the IRB, for all we know this guy came up against an anti-gay bigot, he certainly didn't have someone reviewing his case who was familiar of the realities of being gay around the world, perhaps they should only have gay IRB members working on the cases of gay refugees, they would get a much fairer hearing that way. The IRB will never be changed to ensure fairness for LGBT refugees as long as the Harper Cons are in power in this country, this guy may very well end up dead because of their bigotry and ignorance.

We deport to many refugees
The conservative governments deports too many people without due process. If people would react in this way to deport, deport, deport queers to Iran to hang, then why have a refugee process? The fact is that our refugee process is flawed where clear evidence of ones homosexuality is not considered. Also there is appeal allowed to challenge the decision. The decision can only be reviewed for technical errors. But no knew evidence can be presented. So if you want to support Yasser, then write, email or call Jason Kenny the Minister for Immigration and tell him to let Yasser stay. The more letters, emails and phone calls his office gets, the better the chances for him to stay. Imtiaz Popat

Open Minds, heart and real facts
Like to comment to start with on a previous comment to the person that wrote Deport: Please have your facts straight, most refugees come to start a new life and build a future. Refugees do not live on welfare in Canada they work while they are waiting for their hearing and once they are able to get the PR card they do actually work. They do not abuse the system like others. Now back to the important part which is this person's case. This is not the first case that the IRDB take a negative decision that ends in the refugee to go through longer process to fight for his freedom and prove the facts. Some refugees gets sent to their home land to end up in jail, humiliated, tortured and probably Killed. Others commit suicide while in Canada due to fear of what is going to happen to them when sent back to their own country that they fled from. We do not hear about it in the news as this is negative publicity for the IRDB and Canada. Yes we need to support Yaser and stand up for our rights as a community. Things are changing in front of our eyes and we are opting to look the other way. This government was elected to protect Canadians and Human rights instead we are losing what has been achieved so far with the Human rights and respect to that basic fact. We need to support Yaser and make sure that we are heard. Let Mr Harper and his government know they were elected to keep on building what was built before and not to destroy it. People did not stand up for their rights to allow Mr Harper's team to take it away. Please support Yaser and let Mr Harper and Mr Kenny know that the community is strong and standing behind Yaser and other refugees that need Canada to protect them. Let us open our minds and hearts.

Humanity - is it a Canadian value?
I am sickened to read comments on this page titled deport, deport, deport. Is this what the LGBT community now stands for in Canada? Here is a gay man fighting for his survival in a country that prides itself on it's reputation for its compassion and its humanity. I am ashamed to share a common identity with a Canadian who frames the plight of someone like Yaser as a desperate attempt to get free welfare etc. Let's get our facts straight while keeping our hearts truly queer. Yaser, like so many other queer refugees like him, is a victim of a Canadian refugee system that deports people on a whim, regardless of the circumstances. He is not a nameless statistic, he is a much loved member of LGBT community. The consequences of him being deported are very, very real. Let us come together in the spirit of resistance and supporting each other as has been our tradition when one of our own is being harmed and send a clear message to Mr. Harper, Mr. Kenney and their supporters: we will fight, fight, fight - for justice for Yaser and the many others suffering at the hands of such an unjust system.

Stop the Deportations
I am truly dismayed both by the insanity that is our current immigration systeem, and the likes of "Deport" Ron. The IRB allows a person's fate to be determined by the ill-informed whim of a single member who may be grossly biased and unable to get beyond their own stereotypical understanding of another's reality. Deport" Ron is clearly worthy only of our contempt and disgust. Yaser is indeed a much-loved member of our community, and it is past time for us all to stand up and fight for his right to live here among us! The community I want to belong to remembers what its like to exist on the margins and fights for the rights of everyone. If queer rights are to be truly respected they need extend to include all of us, and this means fighting when one of us is threatened. Please restore my faith and take the time to let Harper and Kenney hear your outrage, and write a letter to the papers while you're at it. Today it's Yaser - tomorrow it could be you...especially if Ron gets his way. No more deportations in our name!!!

No foreigner has a right to Canada
No where in the constitution of Canada does it say any foreigner has a right to stay in Canada at Canadian's expense. It sickens me that so many third world immigrants have the attitude that all they have to do is show up and they are here to stay. You have NO right to be here. Past lib-left governments have fostered this insanity but that gravy train is OVER. Just look at your indignant posts expressing outrage that a Canadian would object to a foreigner refusing to leave. 'my' country?
European settlers who came to this territory and colonized it were legal as this man is, let's not forget about that. I am a Canadian who pays taxes and I want my money to be spent protecting fellow human beings who are contributing to my community rather than paying for a war in Afghanistan, for example. As a country that benefits from the long history of exploitation of people in the developing world, Canada has an obligation to protect those who have to leave their countries due to governments that will not protect them. It's the bare minimum.

Video Documentary short for this case
Hi Yaser and/or his representative: I am interested in doing a short documentary on your case if you want to appear on video (shadowed and voice change is fine if you need it) along with any support folks who want to speak to the case.
