Kulanu withdraws complaint against QuAIA

Kulanu Toronto has withdrawn its complaint against the participation of Queers Against Israeli Apartheid (QuAIA) in the Pride parade because Kulanu's executive director says the integrity of Pride Toronto's dispute resolution process was compromised when Xtra published her original complaint.

In a press release dated June 14, Justine Apple says she was under the impression the dispute resolution process is “private.” Kulanu is a Toronto organization for gay and lesbian Jewish people. Apple says the group was “shocked” to see the full complaint and contact information posted on xtra.ca.

Xtra is considered highly biased and is referred to as the ‘mouthpiece for QUAIA.’ In our view, you cannot separate Xtra from QuAIA, and as such, the entire process feels biased against us,” she stated in the release.

However, on June 12 Apple had recommended the same Xtra story, containing the complaint, on Facebook, writing "Please read this important article." 

The press release was removed from Kulanu's website on June 15 and replaced with a second version that does not accuse Xtra of tampering with a legal process. In the second version, Apple maintains that the dispute committee tainted the process by releasing the document in the first place. “[It was] an enormous breach of trust. It shattered our confidence. It violated our privacy, and it compromised our security. We feel deeply betrayed.”
On June 12 Justine Apple recommended the Xtra story containing the complaint to her Facebook friends. Two days later, she released a statement criticizing Xtra.

 
Apple says Pride Toronto did not make it clear the dispute resolution process would be public. “We feel that real transparency means the dispute resolution committee should have contacted us first before releasing information to the media.”

Apple contacted Xtra on June 13 and asked that the document be removed, including her contact information. Xtra declined to remove the document but blocked out the contact information. 

Apple tells Xtra that after she took time to think about her original comments regarding Xtra, she decided to remove them. The revised press release was sent to other members of the media with instructions to disregard the first statement.

“We were pretty emotional yesterday based on everything that was going on,” she says. “After sleeping on it, we realized that had to be removed. This is about how we feel about the dispute resolution process. We went into it with the best intentions, and we felt that our trust was compromised.”

Lawyer Doug Elliott, who is leading the dispute resolution process, says it’s “false” to claim that releasing the document violates privacy. He says he had been clear that the respondent -- in this case QuAIA -- of any complaint would be alerted if a complaint has been filed.

After Elliott received the complaint from Kulanu on June 8, he says, he sent it to QuAIA immediately, as he is required to do. “The complaint is no longer private once it is filed to the dispute resolution process because it has to be sent to the respondent.

“For her to have an expectation that the information contained in the complaint would be kept private is really beyond my comprehension. It stems from a fundamental misunderstanding of the way the process works,” he says.

Likewise, he adds, it is a standard requirement to include contact information in any legal process, saying that there was nothing requiring Apple to include her personal phone number or address or even her real name. “They could have filed it through a lawyer.

“I’m not sure where they got the impression this would be some sort of anonymous complaint process. Once they sent it to me, it became a public document. QuAIA could have sent it to anyone they liked. They could have plastered it on billboards up and down Church St if they want,” he says.

“The insinuation that I leaked it to Xtra in preference to other media is really completely unfounded,” Elliott says. “If [Toronto Sun columnist] Sue-Ann Levy had of asked me, she would have got the same response.”

Elliott says there have been two other complaints filed against QuAIA’s participation in the Pride parade, and he will likely use the same panel that was assembled for Kulanu’s complaint.

Apple says Kulanu is not affiliated with the other complaints.

“Despite everything that has gone on, we’re looking forward to having a celebratory Pride,” she says. “Our goal is to bring back the inclusivity that we feel has been lost at Pride.”

Filmmaker, writer and historian Sarah Schulman, who is based in New York City and has written extensively on this issue, says Kulanu is attempting to speak for the Jewish community. “I read the Kulanu complaint. They are using the word ‘Jew’ falsely. What they really mean is people who support certain Israeli policies . . . Kulanu uses the word ‘Jew’ in a political sense, not an ethnic or religious sense.”

By trying to silence QuAIA, groups like Kulanu are distracting people from, and essentially condoning, real human rights abuses, Schulman says. “There is an important and vital Palestinian queer movement. Those people are living under separate rules, one for Jews and one for Palestinians. They have been clear that they need the system to change.”

Canadians must look beyond their borders, she says. “These are queer people living in an apartheid situation, and they are asking us to support them in fighting it.

“We live in a global community. If other queer people are telling us what’s happening to them, we have a responsibility to at least allow that voice to be heard,” she says.

QuAIA isn’t alone in its criticism, she says. “Internationally, queer people are talking about occupation. The leaders of our movement are very involved in it. Judith Butler, who is the most important queer theorist in the world, has taken a very strong stance in recognizing that the separate system in Israel is apartheid.

“This is a mainstream conversation inside the global queer community,” she says. “So for Toronto Pride to forbid this is absurd and goes against the trend.”

Schulman says the dispute resolution panel should not have the power to decide whether or not a political issue is discussed at Pride. “If you are accountable to the community, you have open events in which everyone is invited to express their point of view. That is how we functioned for 30 years.”

The larger issue is that Pride Toronto is shackled to its funding; PT should move to hosting an open Pride, free of any government interference, she says. “Let the funding go. It’s not going to kill Pride; it will give it a new vitality.”

“We’re in a moral quandary. Are we so psychologically dependent on government funding that we’re willing to do whatever we’re told? Or have we come to a point when we say we’re not going to take funding anymore and host different kind of events? You don’t need funding. You can have gay pride for nothing. There were many years we had it for free.”

Thank you Mr. Elliot for your legal expertise. Thank you Andrea for a brilliantly and Factual response to both Apples accusations regarding your journalistic integrity, and Kulanu's ongoing accusations toward Pride Toronto. Not to mention the complaint process. Apple isn't ending she is just beginning as she has involved larger straight Jewish organizations to fight their battles. She is just beginning from what I heard. I agree let go of funding but beware of kulanu members making up, and embellishing harassment in a variety of venues where anti Israeli protesters come to close. Now she will be claiming blocks of the street next. What losers, as they think "numbers" make them bigger and better. Best way to deal with Apple and the group is Marginalize them as they have and plan to do to others.

Again the problem with Xtra!
If Xtra had ethics it would fire the person who put the document with the personal contact information it and before posting the document check to see all all personal was not on there before posting it online. But of course they did neither. Also, everyone knows Xtra's coverage of all this is very bias and some kind of wonder why. Also, Xtra is not allowing full freedom of speech on the issue since they seem to only kissing up to QuAIA side. A newspaper with ethics do not promote they report but it is very clear they do not have it .

Why does this paper hate the tiny Jewish State
There are six million Jews living in Israel. There is freedom for Gays in Israel. There is death for Gays in Islamic Countries. The hate that this paper has for Jewish values is comparable to the hate taught from the Muslim Brotherhood.

An independent and impartial arbitrator?
I am troubled by the tone of the statements in this article attributed to Douglas Elliott, the Chair of Pride Toronto's Dispute Resolution Panel. For example, consider these purported statements of Elliott: (quote) For her to have an expectation that the information contained in the complaint would be kept private is really beyond my comprehension. Elliott does not appear to be behaving like an independent and impartial arbitrator. In addition, Elliott is regularly being quoted in Xtra articles on possible outcomes of the dispute resolution process. Xtra is owned by Pink Triangle Press and stays afloat because of Squirt, an online GPS coordinate for men wanting blowjobs in bathrooms and parks. Andrea Houston is a lousy reporter and her only skill is spitting in people's faces with stories like these. But expect the current staff to be there for a long time writing stories like these because no one else will hire them. Either that, or until someone in the dungeon unties Brendan long enough so he can fire them.

Israel-Palestinian question a many headed hydra
When it comes to any discussion about the Israeli-Palestinian question, one is dealing with a many-headed hydra with agendas on the Israeli side from Jewish/Israeli groups on the right and the left and agendas on the Palestinian side from Palestinian groups including the Islamist Hamas and socialist Fatah. As if this weren't complex enough, now we have added to this toxic mix gay libbers polarized into gay Jews who are pro-Israel and gay Leftists who are pro-Palestinian and view the Israeli occupation of the West Bank as a manifestation of apartheid. Now the hydra has 2 new heads fighting one another. None of these arguments and agendas is helpful to the fundamental question of whether or not the Israelis and the Palestinians are going to work out their differences and live in peace? I really don't think that this problem is at all relevant to the lives of gay Jews and non-Jews living in Toronto. This battle has no place in Pride 2012 which is taking place to celebrate the gay community in Toronto. May I suggest that those on the Left who feel strongly that Israel is an apartheid state travel to the West Bank and hang out with Palestinians and make your voices heard there and leave the rest of us gay folks here in Toronto in peace.

Meir Weinstein is truly an expert on hate, as well as promoting ethnic cleansing. Know nothing about him? Weinstein definitely knows a lot about hatred and unlike QuAIA would most definitely be in violation of Toronto's anti-discrimination code for city funding. Yet they marched in Pride two years ago.

Elliott clears the air
While don't agree with some of stories written by Andrea Houstan. I thought this one was a particular good article and well researched. Thank you Mr. Doug Elliot for clearing the air. I find it interesting how the Toronto Jewish Community including affiliated type events latches on to Pride Toronto, but shows no interest or support for any other queer festival in city. How hypocritical of them.

“Fundamental” procedures that aren’t in writing?
In the above article, Douglas Elliott (the chair of Pride Toronto's dispute resolution panel) is quoted as scolding Kulanu's Justine Apple for a fundamental misunderstanding of the way the process works. There are various documents relating to the dispute resolution process on Pride Toronto's website at http://www.pridetoronto.com/festival/dispute-resolution/. One document entitled Pride Toronto Dispute Resolution Process explains how to file a complaint and states that the group that is the subject of the complaint (the respondent) will be notified of the complaint. However, there does not appear to be any express reference in the documents to copies of the complaint being made public or provided to the media. Nor does there appear to be any express reference in the documents about any subsequent panel hearing or process (or subsequent oral or written submissions by the disputing parties) being open or available to the public or the media. Another document is a Q and A which states that the procedure will be governed by the Ontario Arbitrations Act. In Ontario, court processes and decisions are usually open to the public, while arbitration proceedings are usually confidential and only conducted with the disputing parties present - unless an arbitration agreement provides otherwise. If Douglas Elliott contends that it’s fundamental for all documents and proceedings in Pride Toronto’s dispute resolution process to be open to the public and the media, then why don’t any of the dispute resolution documents on Pride Toronto’s website expressly say so? Furthermore, if the complaints were meant to be public, why weren’t they posted on Pride Toronto’s website?

Some commenters are forgetting Martin, Justine, Carol Pasternak and Sue AnnLevy all voiced to Pride Toronto, City Councillors, Brent Hawkes and others that they NEVER wanted a resolution comittee. They were asking for the removal of anything queer and anti Israeli. They said this PROCESS would Not be fair from the beginning. Justine and Martin want to keep this story going for publicity at any cost. IT is totally NOT SURPRISING THEY BACKED OUT OF AN IMPRATIAL RESOLUTION that WAS SET UP FOR THEIR COMPLAINT IN THE FIRST PLACE. Martin, Justine, and SUE ann have used all the othe JEWISH columnists in the Straight Jewish Mainstream to defend them in BIASED ARTICLES. It is Totaslly HYPOCRITAL to blame Mr. Elliot or Andrea and Xtra in General for Bias when this Prejudicial elitist LGBT Jewish group is manipulating and being unethical in their own right claiming victims of anti semetism to the Straight mainstream Jews. The JDL does not speak for all Israel or even Jewish organizations and most Israel and Jewish Organizations hate the JDL since even they consider them to be either a terrorist organization or a hate group. Rich and the QuAIA seem to think they speak for all Israeli and Jewish LGBTs. I wonder why they use the JDL in their propaganda?

If you want to keep Xtra to obey Canadian Piracy Laws and I would even do this for Toronto Pride as well the file a complaint with the Office of the Privacy Commissioner of Canada ( http://www.priv.gc.ca/complaint-plainte/index_e.asp ) I wonder how Andrea Houston or Douglas Elliott would react of their personal information was posted to online for anyone to see? Also, the document that was posted is still available for anyone to see under google cache before it was blanked out

Your comment to Rich lost its validity when Kulanu's Apple invited her face book friend Meir Weinstein to march with Kulanu at Pride. Martin also and Justine publish their personal addresses and phone numbers all over for advertising sake. Martin ran in the Beach's and lobbied quite publicly. To suggest that this was a private complaint given the amount of interviews Gladstone and Apple lobbied for in the media attention. Even withdrawing the complaint was based on more of a complaint. Take a look at the big Complainers. Who really is raining on the Pride parade?

I'm saying this as a collective and I know this is something the QuAIA and any of these kind of organisations can not even separate and yes my point is very relevant. Even I think Kulanu does not speak for everyone but this is something very common with the QuAIA. Also, I not even defending Kulanu.

I saw Meir Weinstein's comment some time ago but thought it best to ignore him since just thinking about him dirties the mind, but when I saw others supporting Weinstein's comment I thought that those who don't know about Weinstein should know about him and what he and his group are all about. I didn't say anything that was not factually 100% true. The JDL did march in Pride despite their history of promoting hatred and clear, unambiguous support for terrorism and crimes against humanity. That is a fact many hundreds of thousands of people can attest to.

Meir this is not a forum and a debate whether Israel should exist as a Jewish State. It is also not a forum or debate whether Israel is democratic and has some human rights laws in place. This is about tolerance to a variety and differing opinions both online and in person at a parade. I don't hear you asking that Kulanu start developing a social conscience and advocate for the Gays in the surrounding arab countries? A Gay person as well as straight can be passionate about any cause without some one pointing out that they should care about All causes in the middle east. You personally do not think homosexuality is "normal". So if nothing else you are a big hypocrite coming to the resue of Lgbt Jews in the name of Israel all along thinking they are sinful. Go fight some real anti semetism. I do think Kulanu will want your presence as a "brawn" tactic as they have developed quite a name for themselves. People clap for Israel, not the people in the group, they haven't caught on yet, that it is not them. A minority within a minority. Welcome to the plight of queer palestians too :)

This is not an issue of privacy, this is once again laying blame to deflect the real reasons behind the arguments. Justine has realized that the complaint had no merit and pursuing it would result in a public demonstration of that. It is best to cut and run and maintain an argument then loose it and try to create a new one.
