Former employee files complaint against Mr Greenjeans

"Since I started working at Greenjeans there was not a single day there I wasn't called a fucking Latino, a spic, a dirty Mexican, a cockroach or a fucking homo," claims Sebastian Jaramillo, who was employed as a waiter at Mr Greenjeans, a busy restaurant within the Toronto Eaton Centre, from Feb 29, 2008 until he quit in April of this year.

A gay refugee from Colombia who has been living in Canada for five years, Jaramillo further claims his manager verbally harassed him, applied unwarranted disciplinary measures such as suspension from work and physically shoved him.

"In Colombia there's nothing you can do if someone treats you badly," says Jaramillo. "It angers me that now, in Canada, people protect this kind of behaviour in others."

In January he filed a grievance with the union Unite Here that went nowhere. According to Jaramillo his union representative informed him in late February that the company's owner and president, Maury Kalen, had responded by saying the grievance was invalid because the union's contract with the restaurant had expired.

Kalen confirms that he received a call but says he didn't find out at that time what the grievance was about. "My response was I wanted to renew the collective agreement, which reached an end in June of 2006. Let's have a contract, let's get the collective agreement formalized and only then can we create a grievance procedure."

But in the meantime Jaramillo says he was struggling to cope with his work situation. "I was fed up and having panic attacks. I couldn't sleep, my mental health has been affected very badly, I am so depressed, I'm freaking out. So I went online and I was looking for help... I came across the Human Rights Tribunal so I went and told a lawyer my story."

That lawyer was the Human Rights Legal Support Centre's Melissa Marks. On Jun 9 she officially filed a complaint with the tribunal on Jaramillo's behalf.

"I just want justice," says Jaramillo. "I don't want anyone else there to go through what I've been through. It's disgusting."

Marks says the alleged violations fall into two categories.

"We're going to argue that the individual who did harass Sebastian was his immediate manager. So a) they're liable for his actions and b) the company is also liable for not taking his complaint seriously, for allowing what we call a poisoned work environment to exist, to allow these comments to go unheeded, with no attempt to rectify the situation at all."

"I'm a little taken aback," responds Kalen. "I started Mr Greenjeans in 1975; we've probably served 15 million people and who knows how many thousands we've employed. I'm proud to say and happy to say this is the first time we've ever had anybody make a human rights complaint."

Kalen says he's asked for a report in writing from the manager named in the complaint. "Whether there's a personality clash between two people I don't know, but I will find out. We will get to the bottom of it, we will do what's right, and we will not tolerate any kind of bias."

The Mr Greenjeans Corporation has 35 days to file a written response, after which the complainant may in turn reply in writing.

"If those parties agree, there will be a mediation scheduled at the tribunal," says Marks.

Jaramillo is seeking compensation for lost wages from the day he left. "We're going to argue that he was compelled to leave, he didn't quit voluntarily," says Marks. "He knew that nothing was going to be done about the harassment so he left."

Jaramillo is also claiming general damages as compensation for injury to "dignity, feelings and self-respect" as provided for in the Ontario Human Rights Code, as well as a few nonmonetary results.

"We are going to be asking for a couple of what are called public interest remedies... to ensure that this discrimination does not occur again," says Marks.

In this case that will include requests that the company institute an antiharassment policy and that the respondents undergo training on the rights and obligations of employees under the Code.

Marks expects the initial process to take six months to one year. "If we don't settle at mediation or if they refuse to mediate then we'll have a hearing before the tribunal."

Although Kalen declined to say whether the company will enter into mediation he says he's committed to rectifying the situation.

"If somebody's been offended in my restaurant, I take it personally," says Kalen. "It will be dealt with."

Kalen adds that as a minority he understands that discrimination isn't acceptable. "My wife and I are both minorities. I'm proud to say we're both Jewish and her parents were survivors of the Holocaust. This is a background that would not tolerate any kind of discrimination whatsoever.

"We're not a big business, we're a family. Gay, straight, white, black, male, female, I could care less. What I care about is respect."

Calls to speak with the manager named in the complaint were not returned by press time.

No more Mr Greenjeans for me
I can’t believe this; I have been a patron of Mr Greenjeans since I moved to downtown TO, it is sad to hear that employees are treated this way. Food is great, service is great but now I just feel awful that this happened and I will not be going there anytime soon. No one has the right to mistreat anyone no matter what their walk of life is or the type of job they do. Does anyone know what the word RESPECT means anymore???.

Outrageous
As a Latin girl myself from Chile, i must say, this is outrageous. Discrimination isn't acceptable. Reading this i understand the issue isn't because he is gay, is because Latin. "spic?" "dirty mexican?". wow... Thats horrible I have been a customer at Green J a couple of times in the past; and have never really found it any good. Food is average and prices are way too high for the quality of the food that you get. I will pass on the word and won't be visiting this place in the near future. Catalina

Baffling
I have eaten at Mr. Greenjeans for years now since discovering it and have never had the slightest complaint about it. The staff are friendly, the food is delicious and there is no semblence of a toxic work environment. Of course I do not know what happens behind the scenes but this is too baffling of a story to comprehend. No restaurant in downtown Toronto would be profitable if it was known to be homophobic or racist. The story states that Mr. Greenjeans has been in operation since 1975 and this is the first human rights complaint ever? If the corporate culture was racist and homophobic then there would have been complaints to the OHRC long ago. I will continue to eat there until the Ontario Human Rights Tribunal proves these allegations are true. It is very possible this employee is on a vengence which is not uncommon after termination of employment. Then again it is also possible that the allegations are true. One would have to see the evidence which the Tribunal is very capable of doing. Point is that for me I am not going to rush to boycott one of my favourite restuarants until these allegations are proven beyond a doubt.

Not really baffling imo
95% of cases were people have experienced discrimination and racism go unheard. Its only the small 5% of the people who actually go ahead and report these situations. Given the circumstances stated on the article, the employee saw himself forced to quit after having complained with management and being ignored, then going to the union which did not go anywhere, and finally going to the human rights tribunal. He followed all his options before going ahead and reporting to the tribunal. Therefore, I really doubt this story is about vengeance, and i am sure if the employee and the human rights tribunal lawyer filed a complaint on his behalf, they have strong evidence to prove that Mr. Green Jeans are guilty of the accusations.

Yup, have to agree with 'allegedly' and 'Baffling' on this one. While I'll be the first to not support an establishment that treats employees unfairly in ANY way, this could be an employee going a bit over the top. maybe he has his own issues he needs to deal with! Aren't they all gay?
I don't see the validity in this, I know quite a few of the wiaters at that restaurant, and they are gay. Everytime i eat there it seems that the waiters(and waitresses) are all happy and joking around with each other and with the management. Could it be that this person is just an unhappy person that can't deal with typical social problems that happen at any workplace??

I knew such a thing was going to happen at GreenJeans LOL. The working environment here is sooo toxic that i dont know how they pulled 15 years there without a lawsuit. Ive been working there for quiet a while, about 3 years already and HATE IT... I work in the kitchen so I dont get to spend much time to socialize with the servrs, however, i witnessed in many ocassions the manager making fun of not only sebastian, but other black workers/indian workers in the kitchen and abusing his authoriry as a manager on racial minorities "making fun of their accent, etc". I always wondered how Sebastian didnt punch him in the face after Duane saying that "MEXICANS SELL ORANGES ON THE STREET, AND THAT HE STOLE THE ORANGES FROM THE RESTAURANT"... I am not going to participate as a witness, i havent even been asked and this is not any of my business.. People, you have no idea what happens behind curtains at GreenJeans, and im glad sebastian stood up for himself.

Get another job
Wow, I used to work at this restaurant and I've seen many people come and go from there. The one thing i liked was the general feeling of family there. Everyone joked around with everyone else. There was lots of name calling and jokes at everyones expense, and everyone gave it just as much as they got it. I quit for school before this alleged abuse happened, but you can't have it both ways. If you are gonna bring your personal life into a job like that you have to beware. And if you are so unhappy in a place, stop whining about it and get a new job.

Drama queen indeed
I've worked at GJ for awhile now, and worked with Sebastian before he left. We all call each other silly names and tease each other... INCLUDING Sebastian. I DEFINITELY remember hearing him use the term "homo", and calling HIMSELF a "dirty Mexican". And any time he was angry with a certain manager I recall the term "fat asshole" (or something to that effect) popping out of his mouth. Every time he was at work, he complained that he'd rather be elsewhere, because it was "boring". He was always trying to get people to take over his section for him so he could go home and do something else. The managers got tired of this and stopped letting him switch, and shortly after THAT he told me he was quitting. FOR THAT REASON. Now suddenly he was harassed??? Sorry, but I'm calling BS. GJ has some of the best managers I've worked for. If you have a problem with them, all you have to do is tell them and the problem stops. If Sebastian was really being harassed, why did he not go to one of the other managers? The owner?? The other staff, at the very least??? You can't go crying to a lawyer every time someone upsets you... you've got to give the offending party a chance to apologize. They might have thought that, since you were PARTICIPATING ACTIVELY in the jokes yourself, you were OK with it. This whole lawsuit is hypocritical and spiteful. Please don't boycott GJ because of this BS lawsuit... we need to make a living.

Do not take any note of these allegations!!!!! Remember...that is all they are at this point.....allegations....simple allegations.........nothing else.... And...they are allegations made by a very unhappy, dissatisfied, and, disgruntled ex-employee of this fine, and, upstanding establishment. I am currently employed by Mr. Green Jeans, and, have worked very closely with all levels of management, fellow staff members, and, Sebastion as well. I can personally assure you that Sebastian was continually displeased with this establishment, any form of authoritative figure, his employment, his career path, the Federal Government, the Provincial Government, the Municipal Government, the refugee system, and his many perceived lack of rights in his new and adopted country..(sorry,I could go on forever about his unhappiness)....but....I think you get the idea..... Sebastion would not do very well, nor would he thrive in his native land; however, Sebastion always feet jilted, and, unappreciated in his new found home in Canada..... Perhaps, Sebastion should return to his native land.....or as he continually would brag to us......a trip to the local bath house so that he could prance around in his little white towel in front of older, promiscuous, and, generous homosexual men.....This was the only outlet that seemed to ever satisfy Sebastion....and....knowing him....he is probably in attendance with these men as we speak.......

SEBASTIAN IS CRAVING MONEY AND ATTENTION
I work as a waiter at Mister Green Jeans, and, have been employed it this restaurant for 8 years. I have never had any problems with management or other staff in all those years. And yes, the letter that is posted above my letter is totally accurate. Wish I knew who wrote it. I laughed my ass off. Anyway, maybe Sebastian is the one that should be charged instead of his immediate supervisor. Sebastian was always telling anyone that was willing to listen how much he enjoyed going to the bath houses, how much he enjoyed random homosexual acts with men that he had never met before, and, how much money older wealthy men would give him for having unprotected sex with them. Just a thought, but, it seems that Sebastion should be charged. He sickened me with all the details that he would go into. And he talked about it each and every day.

From reading the comments above, it seems as though Sebastian did not even attempt to address the matter with his immediate supervisor. Instead it was taken to this ridiculous level. Sebastian, aren't you old enough to engage in 'direct communication'???? Since you had the "balls" to go to the authorities, why couldn't you stand up for yourself in front of the manager who pissed you off in the first place?? Sad little Sebastian
I am a server who has been working at Green jeans for nearly 2 years now. I have had a few jobs in the past and never enjoyed going to work as I do at Greenjeans. Everyone jokes and laughs together, and most of us even spend time together outside work. The managers are all nice to work with and even party with. I have met many gay people working at Greenjeans and have grown to respect and consider most as close friends. My one issue I have ever had with a gay coworker was with Sebastian. His stories would make my stomach turn and I did not find it in good taste when he would tell stories of his sexual escapades in close proximinty of customers' tables. I still get sick thinking about some of those stories I had to listen to. On another note, he was a very lazy worker; he complained frequently about anything and everything. It is just really sad that so many names will be dragged through the mud because of one guy that nobody ever wanted to work with.

Sebastian, I have worked at this restaurant for 7 years. I am a waiter and have many, many friends that work in this place, are managers of the restaurant, and, customers here. I have never, and, I repeat NEVER, had a problem in this establishment, and, I am even MORE HOMO than you could ever dream of being, (note....you are very homo....but....I am a much more deserved queen) You must really get a grip on your attitude, work ethic, life skills, personality, knowledge of right and wrong, appropriateness, and, adjustment to this country after 5 years. I am an immigrant as well. I am also a big faggot. You are too. But I do well in my job beacuse I show up early, work very hard, try to help my co-workers, try to excel in customer service, refuse to complain ad nauseum, get along with everyone, have a positive attitude, complete my side duties, and, I do not spend all my time talking about men that I am sleeping with and where I am picking them up. Sebastian should be sued
I have worked at Green Jeans for over 3 years. It is interesting to note that this article did not mention Sebastian's wonderful story telling abilities. Rimming, fisting, Dirty Sanchez, Cleveland Steamer, gay orgies, bath house trysts, and, snow balling techniques were absent. However, his ex-staff members, gay and straight and young hostesses that are very impressionable heard these stories daily as well as his ability to make great sums of money from wealthy male lovers

was checking for restaurant review...
I was looking for a restaurant rating and came across this. I read it and at first i thought this story was too baffling to be true. However, after reading all the hatred replies from GreenJeans Employees, i cannot give them the benefit of the doubt anymore. If that kind of environment is the one experienced there, then without a doubt I believe the discrimination occurred and still occurs. I guess i found the review i was looking for.

Disgraceful
Wow, How cruel can you people be? Sebastion may not have been the best worker, but for people to insinuate that he was a prostitute is completly unexceptable and untrue. IT's a cheap ploy by mangement and a few of their lackey's to discredit someone. Have a little dignity and own up to your actions. Sebastian may have been a little lazy, but he wasn't a hooker or prostitute, nor did he spend his days telling poeple of his sexual escapades (no more than anyone else did). Whoever wrote those post should be ashamed of themselves. Some of what Sebastion is saying is true, the management do not respect their employees and joy in making it hard for employees to continue working there. The management is unfair, racist and disrepectful. From the floor supervisor, to the managers right up to the owner. While working there the management makes sure that you know your job is always in their hands. People say Sebastian should have gone to the managers, well I am sure that he did. The managers do nothing that contradicts the others, especially the assistant manager. When you have gone to the top and complained, sometimes the law is your only resource. I hope sebastian makes it to court and takes a big chunk of money away from the restaurant. Maybe then they will realize who they should keep and who they should fire.

Sebastian is whining and moaning again
Dear Everyone: I have worked at Mr. Green Jeans for 3 years now. I have never seen a waiter as miserable or lazy as Sebastian. Good God!!!!! You could not get him to clean his tables after his shift was completed, do his side duties, or, his roll ups for the next working shift. He complained, complained, complained, and, complained over and over and over again. In fact, in many instances he was very argumentative and beligerent. Basically, Sebastian was not cut out to perform in the hospitality service industry. He despised anyone that was higher in the food chain than himself, abhored management and figures of authority, and, was negative in each and every way to customers and other staff. Everyone has a niche in life and Sebastian is included. However, the service industry is not one of his strengths. Perhaps Sebastian should seek out another career path other than his frivolous litigation attempts.

Is this going too far? Of course it is, on both sides. I am a current employee of this establishment, and constantly hearing about this dis-grunting. All this is doing for both sides is ruining their reputation. It’s funny though that many people are commenting on this matter, the matter of Sebastian. Sebastian in all honestly wasn’t the greatest employee by any means and if he had a problem with this so called manager he should of got a back bone and talked to them. Rather than a round-about-way pulling it out in a gay magazine which is always going to favour the hurt homosexual. Speaking from personal experience I have been a so called victim of homosexual slander, however it has always been as a joke, which is in all good humour. The management at Mr. GJ’s can be rude, however never push it past the limit and stop when confronted. We live and work in an environment that accepts homosexuality. Sebastian truthfully speaking...Give it up, your not making it easy for anyone and this isn’t good drama for you or for me to work in. This manager has always been open to talking to employee, even if they feel there wrong and listens with an open ear to see both sides. As always, one side pleaded another's comeplete guilt, and the other, their complete innocence. Honestly, both sides are to blame for this situation. I do not doubt for a second that Sebastian was called a homo, faggot, dirty Mexican, or spic, on a regular basis. The comments you hear working in Greenjeans can be genuinely offensive, depending on one's perspective. Most seem to have a mutual agreement to this continual abuse, some do not. Working there is like highschool. You go there to see good friends, have a good time, and put in some hard work on occasion. Like highschool, there is clear segregation, between the managers, servers, kitchen, hosts, ethnicity, sexuality, age, ect. There is also clearly favouritism and targenting to certain individuals by managers which Sebastian fell victim too. I don't think it's too hard to believe it affected him severely. He took the appropriate measures by going to the union and the owner about his situation, which were turned away because we do not have a contract with the union. He was not left with many other options but to go public about it. So Maury, if your response to Sebastian really was "I wanted to renew the collective agreement, which reached an end in June of 2006. Let's have a contract, let's get the collective agreement formalized and only then can we create a grievance procedure", then be a man of your word and give us one. Had you done this 3 years ago, you would of saved us all the trouble of this ugly situation. We wouldn't be on the WORLD WIDE WEB slandering one another and the name of our restaurant. The only thing keeping Greenjeans from being a stable and successful restaurant is the lack of unity, communication and information. Not so different from the world, eh? these people make me sick in this day and age to see people still being treated like this it makes me sick to my stomach toronto is a multicultural city thats something we should embrace shame on the people covering up for the individual or individuals behind this god doesn't like ugly what makes you think that you're better than someone else to make these racist homophobic comments towards them Shame on the people that allow this to happen and shame on the staff thats covering up for the individuals behind this

let me start by asking, What can relly come out of ignorance? nothing but "IGNORANCE"... A few days ago these comments were reported to the moderator and the option to delete them was given; however, after a good thought, i decided to keep them there. they dont affect me AT ALL, they are vicious lies made by very angry and unhappy people. these individuals, which i have been informed of a few so far, are responsible for that. One of them known as "Redneck", A customer from GreenJeans, who is an obssesive alcoholic that does not have anything better to do than to drink beer for hours at GreenJeans is one of them. he has been abusing this system to damage my image and reputation. Man up and put your name, because i knew who you were all along, so did all the people that you told you were using different names to post your LIES and abuse this comment section. if you dont have the courage to come to my face and tell me these things, then have the decency to just keep them to yourself. they depict the kind of coward and rotten individual that you are inside. nothing good, absolutely nothing good can come out of you.. you are the type of individual i would best describe as a "living black-hole" sucks the life out of everything around you. But you are not alone, There's a few others too that i am aware of, including a manager and a few other servers... one of them, a male server also known for spreading and gossiping about everything that goes on at GreenJeans... I don't need to put his name here, He will know who he is when he reads this so will everyone else. do yourself a favour, when you have nothing constructive to say, dont say anything at all. respect is something that you need to learn if you ever want to have real-friends, because everyone around dislike you. If the intentions of those messages were to hurt me,, i feel sorry for all you. I do. because when you use lies, deception to intimidate someone then your battle is over.

Hey Sebas. I just wanted to say I’m proud of you for speaking up for yourself. I personally have nothing against the managers. Although i have witnessed a lack of communication, recognition, and most importantly the RESPECT amongst some workers. Just because we all have different job titles does not make me/you more or less of a person. So don’t act like you’re any better. Many people that work here use intimidation to make you feel like an idiot! To those people, I say F#*@ off! Just do your damn job and quit these petty gossips and fights. ALL of your bitching is unnecessary. No job is expected to be easy that’s why it’s called “WORK”. I use to enjoy working here, but for sometime now I’ve lost the motivation due to lack of acknowledgement. It’s a stressful job, but we’re all going through it. I hope that this issue brings an awareness and resolution in a way to make sure that NO ONE at Greenjeans feels alienated or feels like they’re being mistreated. Maury, if you read this, I really hope something changes. You do have SOME GREAT people who work here, but it’s time to do a hardcore evaluation of Greenjeans restaurant internally from each aspect. Sure, we could continue making all the physical changes of the restaurant by repainting bathroom stalls, buying computers/desks, changing the menu cover…but no improvement is really made when you’ve got unhappy workers. How I wish you could see the TRUE colors of Greenjeans.
