The friends of a Mexican man facing imminent deportation are rallying in a last-ditch effort to allow him to stay in Canada.

Victor Alex Chay Rodriguez, 20, was detained by immigration officials on Oct 19. He's scheduled to be returned to Mexico on Oct 23.

"He's very effeminate, very cute... a young guy," says friend David Garcia. "He was abandoned by his own family. They didn't care to support him in this [immigration] process. So friends are trying to do whatever we can do to stop the deportation.

"He was a fugitive, illegal. He was hiding. Well, kind of hiding because he really had an open life on Church St as a drag queen. We know him as Zuleyka."

Garcia, who is a former president of the queer Latino group Hola, says he fears Rodriguez will die if he is returned to Mexico. He says it's unlikely that Rodriguez, who is HIV-positive and currently undergoing treatment, will be able to continue to get the drugs he needs if he's deported.

"In Mexico there are problems with the distribution of antiretrovirals and HIV treatments.... His doctor already sent a layer to the immigration officer," says Garcia.

Garcia says Rodriguez, who has been living without legal status in Canada for about a year, deserves another chance at the refugee process because mistakes were made in his original applications.

"There were many irregularities in his case since he came to Canada in 2005," says Garcia. "They made mistakes in the personal information file.... They made mistakes in the refugee application. They made lots of mistakes in the PRRA [preremoval risk assessment] application."

Speaking on Oct 23 from immigration holding centre on Rexdale Blvd where he is being detained, Rodriguez says that his HIV-status was not taken into account when he was denied refugee status.

Rodriguez says when he originally filed for refugee status it was with his mother on the grounds that they were fleeing family violence. "When I became an adult I applied based on my sexual orientation... and for the federal court [appeal] and the PRRA it was the same thing.

"I was refused... because they told me I would be safe in another city in Mexico. I'm from the south and they told me I should move to the north."

Garcia says he and other friends have spent the days since Rodriguez was detained trying to find a lawyer to represent him.

"Last night we started a collection," says Garcia. "We raised $1,000 to pay a lawyer to go to the federal court and do this application that can stop the deportation."

Rodriguez confirms that he does now have legal representation and that his new lawyer is attempting to have his deportation order stayed so that he can attend a hearing in his case on Oct 27.

"If I am here I have a hearing to see if I'm going to continue in detention or if they're going to let me go on bond," he says.

If successful, Rodriguez he will have to file a second PRRA based on his sexual orientation and HIV status in hopes that he won't be refused refugee status a fourth time.

No thanks, send him back home.There are plenty of drag clubs in Mexico city where he can work and pay for his own health care. If wants to move to Canada then apply from Mexico as a legitimate immigrant and not a bogus refugee. It is people like him that have forced our government to slap draconian Visa requirements on legit visitors from Mexico. Welcome the world to Canada by all means but,by the front door not the back.

Canada should be a refuge
The sort of Canada I want to see is one that is a refuge for all people fleeing danger in their homeland for whatever reason and that those fleeing danger are welcomed here. These sorts of new Canadians are surely amongst the most devoted and patriotic since its Canada who provided them protection. The vast majority of refugees are hard working people willing to do whatever it takes to survive. The reason so many are on welfare is because they are not allowed to work while their refugee claim is being processed, they have no other choice but to be on welfare since working is illegal for them, if you want to see that changed demand your MP work towards changing that law, its not the refugees' fault and breaking the law will not serve them very well in their application. Overall there are relatively very few refugees in Canada, there are many more actual immigrants who had to endure tests to get admitted that many Canadian born would never be able to pass. Immigration is an investment in our country's future, sure they need some money initially but over time they pay back far more than they needed in getting settled here, they are an investment with a great rate of return. Also when fleeing violence many refugees are not able to make sure all their paper work is in order since they're struggling just to survive, that should not be held against them as its quite understandable and besides Canada has signed international treaties obligating us to take in anyone who has been facing persecution in their originating country, whether from war or in this case a gov't and police force who cannot or will not protect its queer citizens from violence. Telling gay refugees to that they'll be fine as long as they don't act gay, which has happened here in Canada far too often in regards to Mexican queers, is not acceptable. No one should be forced to pretend to be someone else to remain safe.

If he is deported back to Mexico , Victor Alex will suffer ( homophobia , Aidsaphobia ) He will most likely not have the access to life saving anti-retroviral HIV medication , which he does in Canada ! A friendly piece of advice to all the folks responding to Ron:- If you do not want to make your feet dirty then do not kick turds. It rains a lot in Vancouver and in due course Ron will wash away along with all the other poop on the street. No sense in getting Ron all over your feet and then tracking Ron all over your carpet at home.

Didn't come here illegally
To all those saying he shouldn't have come in the back door, he didn't. As I'm reading it he has been here since 2005, but only here illegally for a year. This would mean he came in through official channels to apply for refugee status, with his family, but during the time of processing lost his status as a minor, since he got older (he would've been 16 when he came). Now he's refiled on other grounds, and wants to appeal, but couldn't afford at first so became illegal. Besides that, I would rather my country place the sanctity of life ahead of other policies, and that we erred on the side of compassion.

Do the RIGHT Thing
Deport him back to Mexico and let him apply through the proper channels to legally re-enter Canada if the Federal Gov't allows him. By the way, I personally know of other guys illegally living in Toronto from Mexico. To my knowledge they entered Canada on student or work visas but now they have expired and yet these guys don't return to their country. The unemployment rate in Ontario is very high these days. I believe that jobs should go to people that are legally allowed to work in Canada, not to people living here breaking are laws.
