Toronto City Council’s executive committee has asked the city manager to rewrite the city's anti-discrimination policy to prohibit criticism of Israel, which would directly affect funding for Pride Toronto.

Council requested the review in June because some councillors say Pride Toronto’s $123,807 city grant should be contingent on the non-participation of Queers Against Israeli Apartheid (QuAIA) in the Pride parade.  

Nine deputants spoke to the executive committee Sept 10, saying that the phrase “Israeli Apartheid” is “hurtful” and considered “hate speech.” 

In 2010, council passed a motion requiring that groups participating in any Toronto festival comply with the city’s anti-discrimination policy. Last year, however, city manager Joe Pennachetti released a report that stated QuAIA’s participation in the parade did not violate the city’s anti-discrimination policy.

In June, following a motion by councillor James Pasternak, city council symbolically condemned the phrase “Israeli apartheid,” although the action had no effect on city policy and QuAIA marched in the 2012 Pride parade.

But councillor David Shiner wants the city to go further, “beyond provincial and federal statutes and legislation.”

Shiner’s original motion did not contain the phrase "Israeli Apartheid."

Later, he amended the motion, adding a request for the city manager to consider including: "That in respect of the application of the anti-discrimination policy to the grants programs, in light of the purposes of the grants policy and the community complaints, Council also give specific direction for the imposition of a condition of the funding for the 2013 Pride event, that the term ‘Israeli Apartheid’ not be permitted to be used as part of the event."

Councillor Gord Perks was quick to challenge. “Let me get this straight, you are asking council to restrict speech beyond those that exist in law?"

"Why is criticism of a nation-state unacceptable speech, and why is only Pride the only event we are watching?" Perks asked.

Deputy city manager Brenda Patterson explained the problematic nature of singling out one specific phrase at one city festival. If “Israeli Apartheid” is added, which other potentially offensive terms should also be included? 

“In terms of language, so much of this is in the eye of the beholder. We'd have to specify all terms,” she says. “Those may change over time . . . otherwise, we put our staff at risk of being challenged under the Ontario Human Rights Code.”

Pasternak, who complained that QuAIA enjoys “a certain sense of entitlement,” says Pride Toronto should have done more to keep the group out of the 2012 parade.

“Pride came to us and told us about their dispute process. I’ve heard plenty of complaints about their dispute process,” he says. “It's nothing but a kangaroo court.”

The dispute resolution process, chaired by lawyer Douglas Elliott, was implemented following a recommendation which came out of a series of meetings held by the community advisory panel, CAP. The panel was convened after a bitter three-year public fight over QuAIA's participation in Pride. PT describes the dispute process as an arm's-length legal arbitration panel for anyone who wishes to complain about any group marching in the parade. The panel's decision is supposed to be final.

Elliott says the DRP has received about seven complaints to date. In June, the panel of lawyers dismissed a complaint from B’nai Brith, determining that QuAIA does not fall outside the core mission of Pride Toronto, nor does it “present images or messages that promote, condone or may promote or condone violence, hatred, degradation or negative stereotypes of a person or group.”

Mr Pasternak is really one of those people with strong opinions on the subject of Israel and I’m afraid it colours anything he has to say on the subject,” Elliott says. “People on the DRP are all very distinguished lawyers, all well-qualified people, certainly more qualified than Mr Pasternak to rule on legal questions . . . I think it’s sleazy politics on his part.”

Using the phrase “Israeli Apartheid” to describe the Israeli government's policy in regard to the Palestinian Territories is not new, and QuAIA is not the first to say it.

Journalists, academics, and even former US President Jimmy Carter, have called Israel an apartheid state. Desmond Tutu, the 1984 Nobel Peace Prize winner, has said the situation in Israel very much resembles South Africa when it was an apartheid state.

But Shiner disagrees. “[Apartheid] is not happening in that country. I challenge anyone to get on a plane and go see what’s happening. People there are all free in the state of Israel. They are free and they all have their rights there. They are not treated as people were during the horrible events that happened in South Africa.”

The nine to one vote did not include the mayor, who was absent during the debate. The one dissenting vote came from councillor Norm Kelly.

The anti-discrimination policy was sent back to the city manager and will return to executive committee in 2013.

Not this old canard again. Don't these right wing,misinformed politicians ever follow the city's and the Pride Toronto's own independent thoughtful ruling on this? "Israeli Apartheid" as an expression of a strong point of view should not even be on the Executive Committee agenda as the city has already ruled on the legality of the expression. And so has Pride Toronto after a dispute resolution's process was initiated just before 2012's Pride. The matter ought to closed. I for one would rather stop taking city money for Pride than allow the city to interfere with who does or doesn't march in a Pride parade or what expressions may not be used. Let's hope that the Executive Committee comes to its senses or that the whole of City Council will overrule what the Executive Committee has tentatively ruled.it has been discussed, dissected and analyzed for over 2 years now by the City, by Pride Toronto, & the LGBT community. Enough!!! Let Pride be Pride. Enough political interference by city politicians in who marches in Pride as it is an internal LGBT community & Pride Toronto matter.

If QuAIA doesn’t give up, why should their opponents? This issue will be alive as long as QuAIA continues its hateful campaign against gay-friendly Israel at Pride and other LGBT events (e.g., the Vancouver Queer Film Festival). QuAIA singles out Israel for condemnation at Pride, while ignoring how Israel’s Muslim enemies persecute gays and oppress women. QuAIA has brought hate to Pride (including the trans march, the dyke march and the main parade on Sunday) and ruined Pride Week for many people. What used to be a time for LGBT people to come together, is now a time of division, anger and hatred for the LGBT supporters and opponents of Israel. QuAIA has hijacked the LGBT rights agenda of Pride in favour of their poisoned Mid-East politics. By demonizing Jewish people who live in Israel, QuAIA deeply offends many Jewish people in the LGBT community and their friends. This will result in a great legacy of bitterness and distrust in the LGBT community. As a result, the opponents of QuAIA have nothing to lose by continuing to oppose QuAIA at any available opportunity - including by lobbying Pride's government and corporate donors. I have been personally attacked by hateful QuAIA supporters online and at LGBT gatherings, so I will continue to oppose them. QuAIA’s recent antics at the Vancouver Queer Film Festival have left no doubt in my mind that QuAIA will be escalating their campaign against Jewish people who live in Israel.

Let Pride by Pride
Well, Joe, maybe some of us voted for those right-wing politicians that Mr Dubro thinks are out to get the gay community. He's assuming we're all left wing. Or give a shit about politics. Who is he to make assumptions like that? My favourite sentence though is "Let Pride be Pride". QuAIA (along with Xtar and its other supporters) is doing its best to destroy Pride. How many Jews enjoy Pride now?? It's suppose to be a celebration about being gay. Politics should be restricted to gay issues. But I suspect this is not your definition of "Pride". But you speak for all of us, so my view doesn't count, right?

It looks like two of QuAIA's greatest supporters won't be resuming their previous roles during the next battle over QuAIA marching in Pride. First, since Matt Mills' name has disappeared from Xtra's masthead, I assume he no longer holds an editorial position at Xtra. Pride is for ALL not just some of LGBT
All I can say to person calling himself Jim is that I have been in every Pride march/celebration since before there was Pride as such. And always anyone marched who felt like it with any sign he made. I wasn't being arrogant as the City lawyers AND the Pride Toronto committee (the new Human rights resolutions process)have made their rulings in the past year after much angst discussion over the past two and half years. If that is arrogant to say "enuf" then so be it--Ive been active in the LGBT community as a resident, bar/party-goer, & journalistic observer for 42 years so have some right to make observations. My saying Let Pride be Pride is simply allowing for full expression of all views --within the existing laws of course. Pride has always been political as well as social and a celebration. I don't mean to offend anyone-I was just exasperated by the endless wranglings by City council Executive Committee for political reasons over things already solved as it a waste of taxpayer's time & money & demagougery. I respect those who do not think a group should attend the parade with a certain sign, but I don't beleive that is the spirit of Pride as I habve known & experienced it for 43 years plus. That's all Jim. It isn't left wing/right only--I happen to be a progressive small 'l" libertarian who thinks the least state involvement in our affairs the best unless it helps the weak and those not able to help themselves (hardly the official gay community with all our lucrative gay bars& busineses around).So Jim, get a grip, stop name calling (& being arrogant,lol) , use your real full name,& protest against the offending group at Pride but don't try and stop free expression of a point of view just because it isn't yours. (cont'd) ...what they at least consider an important human rights issue of interest to some in the LGBT community. Obviously there are lots of points of view on this issue and they are usually all expressed at Pride which is mostly a celebration of gay life but is also a march about the importance of our human rights. I for one welcome all to march at Pride who have anything political, social or relevant to say-even the many blatantly commercial interests that march(or have a float) have a right to do so in Pride. That's what it is all about, our all to fragile human rights as LGBT people. When one group is attacked or banned, inthe end we are all diminished.

Banning gay groups from gay events
Usually it’s the local gay left-wing establishment, rather than the local city council, that bans a specific gay group from an LGBT event (like Pride) or an LGBT venue. For example,(1) Even though it purports to support QuAIA marching in Pride for reasons of free speech, the board of The 519 Community Centre banned HEAL (a gay group that questioned whether HIV causes AIDS) from The 519 – see http://healtoronto.com/globesg.html.(2) The North American Man Boy Love Association (a gay group that supports sex between men and boys) has been banned from gay pride parades in many cities – see http://en.wikipedia.org/wiki/North_American_Man/Boy_Love_Association. James Dubro: I too have been in Pride parades for 40-something years - on two continents. And to keep repeating the "Pride-has-always-been-political mantra is a red herring. YES...Pride has always been political about GAY issues. NOT political about supporting groups who are homophobic - and I mean the majority of Palestinians who QuAIA support. More to the point, QuAIA has stolen its Israeli-apartheid phrase directly from Israeli Leftists. But there is one difference between the two; ask an Israeli Leftist if Israel should have the right to exist and he will reply immediately YES... ask QuAIA that same question and they will prevaricate - because in fact, they don't. Even more to the point, why is Israel being singled out for bad conduct? In Sudan, Muslim on Muslim violence has killed 10 times more than the Israeli/Palestinian conflict..but the people at QuAIA don't see fit to mention this in Pride or anywhere else - ask them why! Don't dead Muslims killed by Muslims deserve support too? I personally know one of the major spokesmen for QuAIA...he used to have a poster on his wall of a gun-sight aimed at a Jewish star. But nooooo, he's not anti-Semitic...it's just pure accident that he remains totally blinkered to anything atrocious done by a Muslim, because that is Political Correctness in Toronto these days. BRAVO KEN ! “The day QuAIA also dares to go to the West Bank and Gaza and parade around with banners insisting on Gay Rights - then I'll say they have a right to be in Pride.” Indeed Israel has a right to exist in peace; Palestinians have a right to self determination; Israeli Leftists should be able to protest against their own country's policies - but none of that has anything to do with the Toronto PRIDE Parade. ***PRIDE should make the distinction - once and for all - that only LGBT related issues are allowed in the PRIDE Parade.*** Why not have a referendum on this issue amongst the PRIDE membership or the LGBT population of Toronto? Mistreatment of LGBT in Muslim countries
Why are the QuAIA and SALAAM Gay Muslims not protesting in the PRIDE Parade against laws and actual mistreatment of LGBT people in Muslim countries ? That's a major LGBT issue. This topic cannot be ignored any longer. World Pride must deal with violence against and exclusion of Gays/LGBT in Muslim countries.

I remember when Pride was about fighting for LGBT freedoms and celebrating our culture (yes we have one), but now? it's all about the politics of the Middle East, what a waste. Be it Isreal or Palestine, Gaza or Syria, we are talking about a fight that has gone on for millenia, to no avail. Why must Pride take up this banner? are there not other days in the year that, those opposed to Isreal or those who support it, can march, chant and just plain bitch? NO? Why is that? Oh right.....because Pride isn't about us faggots anymore, it's about Far Left and Far Right politics that have ZERO bearing on the LGBT community.
