The September 27, 2008 assault on Jordan Smith in Vancouver's Gay Village was a hate crime, a BC Supreme Court judge ruled April 30.

Smith and his partner had been walking hand in hand when homophobic taunts preceded the assault that left Smith unconscious on a sidewalk, his jaw broken.

Justice Joel Groves called the assault "vicious" and "senseless."

He said a severe sentence was needed for Michael Kandola and sentenced him to 17 months in prison.

Minus five months for time served, Kandola will spend the next year behind bars.

"Hatred is a motivation in this crime," the judge ruled. "There is no other explanation for what happened on that date."

"Mr Kandola must know that his actions are not only contrary to the law but are abhorred by Canadian society," Groves said.

"It is hard to fathom in this day and age how two men holding hands can cause such a visceral reaction in the accused," Groves said. "In Canada, people are free to live their lives as they choose, be they heterosexual or homosexual."

While Smith was not in court, due to work obligations, his partner, Charles McKay, who was also confronted by Kandola that night, was in court for the ruling.

"Wow," he said as he realized the judge was going to be as severe as he could be in sentencing. Tears streamed down his face.

He said outside court the sentence allows him some closure.

"I didn't realize I would be so emotional about it," McKay said.

"It should make people aware," he said. "I loved how [Groves] said Canada is not a place that accepts this kind of behaviour."

Groves said the sentence should act as deterrence to those who might also consider crimes motivated by hatred.

"Those who act like he [Kandola] did on Sept 27, 2008 must know that there are real consequences for their behaviour," Groves said.

Kandola was originally charged with aggravated assault but pleaded guilty in March to the lesser charge of assault causing bodily harm.

The charge stemmed from the attack on Smith at the corner of Davie and Hornby streets in Vancouver's West End.

Smith and his boyfriend, McKay, had been walking up Davie St holding hands when they heard taunts of "Faggots," "What the fuck is this?" and "Why are you faggots holding hands?" from a group of men behind them.

Groves called the behaviour "bullying."

Smith let go of McKay's hand and turned back to ask the men what they meant.

Groves dismissed the submission from Kandola's lawyer, Danny Markovitz, that this was an act of provocation on Smith's part.

"The circumstances are that Mr Smith arrived at a corner and was assaulted, he was bullied," Groves said. "There is no evidence here that anything Mr Smith said or did constituted provocation."

Groves said the "gang" then backed Smith up into range of a video camera at the 7-Eleven at the corner.

Groves said the video clearly showed Kandola then circling around behind Smith, "dramatically winding up and hitting the accused from his blind side."

The video is consistent with statements of witnesses.

One witness, Groves said, told police "all of a sudden, the accused (Kandola) hauled off and sucker-punched the victim right in the face."

The judge noted it was only when a cab driver yelled that he was filming the event and that the police were on their way that Kandola stopped the attack and the group fled.

"The physical injuries to Mr Smith were significant," Groves said, noting Smith needed emergency surgery for a broken jaw, had his jaw wired shut and suffered a concussion.

Groves noted that the fact Smith was unconscious on the ground did not stop Kandola's assault. He said one witness stated Kandola continued to scream obscenities at the prone Smith and threatened to "do him in."

Markovitz had submitted that though homophobic language was used before and after the offence, no slurs were uttered while the punch was thrown. Therefore, he had argued, it could not be a hate crime.

Groves disagreed.

"It is a continuous, flowing event," he ruled.

"Hatred is a factor I must consider in sentencing."

In order for him to rule the assault a hate crime, Groves said the Crown needed to prove homophobic language was used before, during or after the assault; that the attack occurred in a gay area; that there was no previous interaction between the parties; and that no alternate explanation was available.

He said Crown prosecutor Dasein Nearing proved all those factors.

Kandola's lawyer, Danny Markovitz, asked to read a letter of apology from his client before the judge began to pass sentence. He acknowledged it would have "absolutely no effect" on sentence.

"I apologize," Kandola said in the letter read to the court. "I am not now nor have I ever been a person who discriminates against gay people."

Outside court, McKay called the letter "a joke."

"I'd like to believe and hope the letter was genuine," he added.

Groves found "the evidence of remorse in this case is limited and late in the day."

In imposing sentence, Groves noted the offence occurred prior to Parliament's removing the two-for-one recognition of time served in jail prior to sentencing.

As Kandola has served 2-1/4 months in jail on the charge, that means he gets five months' credit on the 17-month sentence.

In addition to the sentence, Kandola must serve a year's probation, not be in downtown Vancouver, including the Gay Village, for that period and cannot contact Smith or McKay. He must also perform 50 hours of community work service.

"You are young. You have time to change your ways," Groves told Kandola. "It is not too late for you to turn your life around."

Just the fact that this gay bashing was recognized as a hate crime was significant, too often in my opinion do gay bashings get brushed off as a simple assault. To me the sentence seemed a little on the light side though I understand for this sort of assault the jail term was on the high side, still I think a longer period of probation would have been in order if not a longer jail term.

Great News
These is great news too bad it could not be longer.....Now Jordan Smith needs to file a civil suit against Michael Kandola for 2 or 3 million and take Michael Kandola assets. This will send a message that if you do this you will pay for it in more ways then one....Jordan Smith can sue him for medical treatment...lost of wages....and the fact that I am sure he is scared at times to walk the streets in Vancouver....

Precedence...
In December of '02 I was the victim of a gay bashing in downtown Toronto. Long story short, I was knocked to the ground by 2 guys and they kicked the shit out of my head. I managed to get up and walk home as a passer by was walking towards were the incident happened. I don't know or remember this person, but to me he was my guardian angel. My attackers were never caught & I spent the night in the ER. I had a broken nose, fractured skull, chipped & broken teeth, & now proudly smile with a fake tooth. I received stitches to the back of my head & suffered from a minor concussion. CATScans were done for fear of swelling, but I managed to survive. I then spent the next following months seeing ENT specialists and numerous dental visits to the amazing team of doctors & students an Mount Sinai Hospital. Not to mention the emotional counselling I went through to regain my confidence in walking alone at night. Still, even to this day, I'll have an anxiety attack if I'm in any situation that even closely resembles the experience that I went through that night. Completely life altering. This is a moment in my life that I will NEVER forget; all because I was walking home alone one night & happened to be in the wrong place at the wrong time. I'm truly lucky to be alive right now and would never wish this experience upon anyone! My life has changed greatly from that potentially fateful night 8 years ago - yet it still sickens me that crap like this is still happening. I'm glad that the gay bashing was recognized and didn't get brushed off as a domestic disturbance. I feel for Jordan & can completely relate to & understand what he is going through... even though the incident was 2 years ago. This is something that will never leave you. His attacker was caught & is an example that hate crime will not be tolerated; at least in BC. More people need to speak up as I know I personally struggled with shame

It's satisfying to see that not only has the gay basher in this case been sentenced, but that he was actually caught in the first place. As KC pointed out, most gay bashers miraculously get away with it. Any update on Christopher Skinner's murdereres? That attack was captured on video and yet nobody was arrested. This is a sick world.

Glad to see the judge concluded it was a gay bashing/ hate crime ( a first in BC ? ). The sentence ruling was average for someone commiting an assault and nothing more.The victim of this crime has a life time of dealing with the pain.Kandola got off easy.Even if Jordan Smith sues him Kandola may just shake it off.Justice is blind and dumb.Kandola is young with a future but were are just a bunch of homos, eh.

People in glass houses...
Michael Kandola, himself a visible minority, has committed a hate crime. In doing so, he not only has harmed a member of the (Canadian) gay community, he has left a black mark on his own Indo-Canadian community by engaging in an act of bigotry. Mr. Kandola is guilty of two crimes: a hate crime against another human being and conduct unbecoming of a visible minority in Canada. As a member of a visible minority, he should be well aware of how serious a crime bigotry is! He deserves the 17 months he got, and he should be made an example of. Furthermore, if he was born outside of Canada, he should be deported. We don't need bigots coming to Canada from overseas, we have enough of our own.

Result is unsatisfactory, blame CJB
Criminal Code of Canada: "Every one commits an aggravated assault who wounds, maims, disfigures or endangers the life of the complainant." There was no reason to plea bargain this case to a lesser charge. Aggravated assault carries a 14 year maximum although the typical sentence is 5 years. Everyone stands exposed
How come white gay killers like shawn woodward and ryan cran never get a hate cime charge they actually killed gay people in Vancouver. Also, why the comments on here are obssesed with ethnicity of the perpatrator this time, which they normally are not when they are mostly caucasian. Also, this guy grew up in the fraser valley and the last time i checked homophobia was pretty rampant in Valley schools where "all church" public school board members like Heather stilwell were actively banning gay references in books and firing gay teachers, this guy is a product of that school system. I remeber in the 90's skinheads routinely came downtown from white rock, langley and surrey to beat up fags after beating brown guys on school premises on the first day of school. There seems to be a lot of racist sentiment here in the lower mainland in general and the gay community reflects that as well. Jordan smith said in his first interview in XTRA that when he was walking down the street he saw an east indian guy yell at him. Would he mention the race if the guy was white and say some white guy yelled at me and punched me??? And by the way Jordan grew up in White rock where this kind of talk is normal. This just shows that we are bringing our parent's prejudices with us to the gay community. The media is resposible for it more than anyone. Why supress stories when gay bashers are white? why not ask for hate crime charges then? why not publish the crime to death? In other words gay guys should just hope and pray that if they get bashed its a brown guy not white or else they won't get justice and the gutter media won't take up their cause.

To JAY from Vancouver, You are sadly misinformed. To suggest there is a Racial issue is completely false and outrageous. To suggest that I might have some preconceived prejudice passed on from my parents because I happen to be from White Rock is actually comical. People from White rock are no different than people from Vancouver. Im not sure where you have collected your so called facts? Did you do a poll or somthing? These are baseless opinions, that have no substance behind them. Because I identified Michael Kandola as being an east indian does not make me a racist? If we went by your amazing theory, how would we Identify anyone? How would I describe to the police what this person looked like? Dont try and flip this around into a race issue, its a rather sad attempt on your part. Next time you want to voice your large opinions try and do a little research before. Your letter is very ignorant. He was charged and convicted because the evidence was overwhelming and irrefutable not because he happened to be a non-white. It was a HATE CRIME. end of story.

The apology
The apology was BS. Kandola cannot say "I am not now nor have I ever been a person who discriminates against gay people." Even without the assault, his words were discriminating and hateful. I might, and I stress might, have believed him if he had said that over these past couple of years he has learned how wrong his behavior was and that he was sorry and would work to become a more open-minded person. But to say he is not now, and never was, a bigot is a lie and it's clear he's not learned a thing. And I know it's his lawyer's job to defend him, but how his lawyer did it and how he claimed it was not a hate crime has probably been driven into Kandola's mind so much that he'll never learn that what he did was wrong. I hope his community service includes some learning activities in diverse group settings.

Tough on Crime
I am very happy with the outcome of this sentencing - while being puzzled by Xtra's editorial position that condemns the current government's tough on crime agenda. Should we let Kandola out of prison early because it costs too much? I think not! It's why I am tough on crime and proud to support the Conservative Party's tough on crime agenda!

I think you may be mixing up physical description with racial descrimanation. If Mr. Smith had been attacked by ME he would have described me as a White man , with long hair in his late 30's who is very heavy set and was in drag. This does not make Mr. Smith ageist, sizeist or transphobic just ACCURATE! If you read Justice Groves REALLY well presented ruling you will see that Jordan did NOTHING to aggravate his attacker. To attempt to re-intruduce Mr. Smith as anything other than the innocent victem he is is naive at best. We can only pray that there are no more senseless attacks in the future...
