"Mr Woodward has fabricated that story to justify his outrageous assault on Mr Dowrey," Judge Jocelyn Palmer ruled this morning in Vancouver Provincial Court.

Guilty.

That's the decision of provincial court Judge Jocelyn Palmer in the charge of aggravated assault against Shawn Woodward for his March 13, 2009 punch that left a gay Vancouver man in a Fraser Valley care home.

Woodward had relied on a self-defence claim to extricate himself from the charges. He testified that Ritchie Dowrey had touched his crotch in Vancouver's Fountainhead Pub.

Palmer wasn't buying it.

"I find there is no air of reality to Mr Woodward's evidence about the alleged sexual assault," she told a courtroom packed with more than 80 people, including members of the queer community, Dowrey's family and pub staff.

"Mr Woodward has fabricated that story to justify his outrageous assault on Mr Dowrey."

She said Woodward went directly towards Dowrey with the sole purpose of punching him to protect his own manhood.

Woodward had testified that he knew he was in a gay bar, having been there before.

"He stated gratuitously that he was unaffected by that," Palmer said.

Woodward told the court Dowrey had offered to buy him a drink, touched him on the shoulder and later put his arm around him before grazing his thigh.

"He's a faggot. He deserved it. The faggot touched me. He deserved it," pub patron Lindsay Wincherauk testified Woodward told witnesses while being detained for police.

Woodward told police he wanted Dowrey charged with sexual assault.

"I felt his hand graze across my thigh toward my crotch," Woodward testified at trial. "I closed my fist and punched him in the chin. He fumbled backwards and fell."

But, Palmer noted, Wincherauk testified he could see Dowrey's hands while Woodward had his back to Wincherauk prior to the punch.

That the punch happened was not in contention in the case, having been admitted by Crown and defence.

Several witnesses saw it and the judge accepted their testimony.

She quoted Wincherauk as saying Woodward "hit Mr Dowrey square on the right side of his face with a sickening thud."

Dowrey then fell straight backward and hit his head on a tile floor.

Palmer also appeared to have no issues with the testimony of head bartender Scott Larin who also testified to hearing Woodward say, "He's a faggot, he deserved it."

Palmer said Larin "characterized the accused's tone as if he had done something good."

Larin testified Dowrey had one double gin and had ordered a second, which was waiting on the bar untouched at the time of the assault.

The judge questioned the testimony of Woodward's longtime friend and roommate Greg Price.

Price had testified Dowrey was slurring his words.

But, Palmer said, evidence indicated Price could not hear Dowrey.

Price had told the court he had been invited down to the bar by Woodward who paid for a cab to get him there - even though they were supposedly planning to go for dinner afterwards.

The judge noted that Price, "supposedly an avid Canucks fan," could not remember who was playing that night.

Palmer found Price was "hedgy" on the stand, and had aligned his evidence with Woodward's.

But Palmer saved most of her criticism for Woodward.

She found he embellished or adjusted his evidence at various times.

"I did not find Mr Woodward to be a credible witness," she said. "I did not believe his evidence.

"I find Mr Woodward is prepared to deny, deflect and dissemble."

However, she added, she did accept Woodward's evidence that he was offended by Dowrey's possible suggestion he was gay.

Woodward testified that Dowrey told him, "You'll be back" right before he punched him.

Outside court, Woodward remained silent as reporters and cameras chased him down the street asking if he had a message for the man he is now convicted of assaulting.

Dowrey himself cannot comment as a result of the brain injuries he sustained. He remains in a care home where he is unable to clothe, feed or clean himself.

"In this case, the complainant is unable to testify due to the injuries he sustained," Palmer noted.

She said medical evidence showed Dowrey sustained a skull fracture from the punch. Other injuries, which the court heard earlier, included a shifting of the brain and bleeding in the skull.

The case now moves to Oct 22 for sentencing.

It's at that point that any evidence of a hate crime would be presented to Palmer for a stiffer sentence.

Crown spokesperson Neil MacKenzie would not comment on what would be presented to the judge at sentencing.

"We will take into account the findings that the court made with respect to this incident," he says, acknowledging the judge "clearly used some strong language."

When Palmer announced her guilty verdict, some people in the gallery began clapping.

"Don't you dare," a stern Palmer admonished, as sheriffs moved around Woodward and lawyer Joel Whysall before clearing the courtroom.

Members of the gay community want to see a hate crime designation in the case.

Ron Stipp of West Enders Against Violence Everywhere says Palmer's judgment opens the door for such a designation.

He believes it was readily apparent Woodward went to the pub that night "to bash fags."

Stipp says the ruling is an indication that the days of the homo panic defence are over.

"The whole notion of self-defence was ripped apart in that judgment," Stipp says.

Palmer's ruling sends an important message to would-be gaybashers, says Jennifer Breakspear, executive director of BC's queer resource centre Qmunity.

"If folks are looking to cause trouble on Davie, know that the police are looking out for us and we're looking out for each other."

Fountainhead manager Derek White says no matter what Woodward's punishment is, nothing will bring back Dowrey.

"I'm glad she [the judge] was able to see through his lies," White says.

Asked what message Palmer's decision sends to potential bashers, White says, "Don't do it. This is our community. We're going to nurture this as a safe environment. We will not be bullied."

Little Sister's manager Janine Fuller was in court and called Palmer's ruling a good decision.

"The family has been amazing through this," she says. "They're the real heroes who have survived this hellish ordeal."

"Ritchie's not coming back," Wincherauk says. "I'm glad there's an outcome where justice will be served."

Time to Wake up People
Now all as we have to do, is see what the SLAP ON THE WRIST is that the judge gives this closeted homosexual. I bet it's less than 6 months in jail. The sentence for Ritchie Dowrey, a life sentence of health issues. I hope all the Liberal, bleeding hearts through out Canada (especially in Toronto) are happy with the laws that the Federal Liberal Party of Canada enacted over the many decades they were in power. Animals like Shawn Woodward, get away with this shit all the time in our country with little more than a slap on the hand for being naughty, when really, they should be locked up for at least 6 to 10 years.

Jeff Just because a person is in a gay bar doesn't make them gay or a closeted gay they might be there with friends are just out having a beer. I have several straight friends who come to gay bars with me as I go to straight bars with them ...does that make me a closet straight?? Why do we always assume a straight guy in a gay gay are closeted????

Not the issue here
Eric, this is not the issue gay or straight. Woodward was fully aware he was in a gay bar period. If you're a straight guy in a gay bar chances are you "may" get hit on, other's may assume that you are gay. Should be pretty simple to understand. Regardless a man's life has been changed forever you might say that his life is effectively over. Woodward has been found guilty and my fear, as Jeff refers to in his post, the sentence will most likely not fit the crime. Our "injustice system" has failed us so many times before, not just the gay community but all communities. I fully expect there to be a light sentence because that's just the way it goes. Sad.

homophobe in a gay bar?
Here in the US... we don't hear about these issues, unless some one is killed or hurt beyond belief. Why was Mr Wood ward in a gay bar? Did he think he was in control, while sending out signals that he wanted some attention? And to admit that he knew it was a gay bar, is way out of place in his story. Does he hate women? Does he feel like he belongs, just cant admit it to himself? He should be locked up in solitary confinement so he can think about how he has changed the life of the man he assaulted. He says "He is a faggot and deserved i"t.. I think he is the faggot and should deserves more than just a slap on the wrist.

Do the Research
@ Eric, I'd be willing to bet that your friends DON'T punch someone in the head while they are at the gay bars with you. The fact that this pig was violent towards Mr. Dowrey, measures up perfectly with decades of research on supposed straight males that act out violently against gay males is in fact because they themselves have conflicting sexual identities issues. Just like I'd be willing to bet that your straight friend don't PUNCH people in the head when they are in gay bars, I'd equally be willing to bet that Mr. Woodward has sexuality issue himself. Do the research - it's out there in dozens of studies.

The leniency of sentences given to Homophobes who commit hate crimes come from CONSERVATIVE JUDGES who coddle their straight bretheren and give NO QUARTER to LGBTs. You are wrong. wrong. wrong. From a distance I see a nascent and encroaching right-wing conservative wave arising in Canada. As an American who's seen it all, I have to say: BEAT IT BACK! You have little or NO clue
Dear Roger, did you actually read my first comments ? It's seems that you did NOT read them or if you did, you were too busy being angry to understand them. Now, I'll take a few minutes to educate you on how things actually work up here in Canada. It's really VERY simple Roger. Up here in the Great White North, judges are given sentencing guidelines & laws as enacted by our Federal Govt. Judges do NOT make up laws as they go along. Two more educational pieces for you Roger, many of the judges that are still handing out sentences in Canada in 2010, were actually appointed by Liberal lead Govt's over the decades they have be in power. Canada is known around the world for having lax laws regarding drugs, white collar crime, and even degrees of murder. As for my original comments about the Federal Liberal Party of Canada being the ones that are behind the implementation of many of Canada's "soft" laws - pick a law of Canada (any law you'd like to educate yourself about) and google it. You'll find that 8 out of 10 times a Liberal Govt was in power at the that time. I know Roger, your type never likes FACTS to get in the way of your agenda when you're trying to make a point against Conservative Govt's, politicians, and yes Roger, even Conservative Judges (the one's that rarely exist in Canada). Now Roger, you run along and continue navel-gazing down South pretending you know what you're talking about - even when your comments prove that you don't. P.S. Roger, have you noticed that Canada has gay marriage - still, while the USA, under the Democrats (your country's version of our Federal Liberal party) does NOT. And, next time your want to lecture someone, pick someone that doesn't know that facts - much like yourself.

Sorry, but I may have accidentally sent a non-message just prior to this.As a Canadian who has lived in both countries, it's sad to see a fellow-citizen falling for the conservative versus liberal propaganda that has taken hold to the south.I strongly; is I'm permitted to; recommend the book 'The Armageddon Factor'by Marci MacDonald.We have attained the progress we have here in Canada because of liberal thinkers in both the Liberal & NDP quarters.Through the years, I've had three friends murdered in brutal hate crimes that have never been solved, because of conservative thinking; i.e.-indifference or hostility.As for our judicial system, there's plenty of blame to go around.I am also anxious to see what kind of sentence Woodward will get.I was stunned when Ryan Cran was handed 6 years for the murder of Aaron Webster. He did 4 years & is now out.It should be noted also, that US judges don't make up laws, but interpret the constitution in each case, which is what their job consists of. If they rule in opposition to what the religious right wants, they're called "activist", & the cry goes out for"impeachment". I urge some of you to take a look at Hansards , which documents every moment in the House of Commons, & see how party members voted when it came to gay issues.There's been little support from the Conservatives, & Ottawa is presently crawling with Bible thumpers eager to overturn our gains.Check out the websites of the religious right here in Canada.Their aims & rhetoric are appalling. They refuse to recognize hate crimes where sexual orientation is involved.Our friends to the south are right to warn all Canadians about what is quietly happening to our federal government.

Let's Focus On the Key Issue
First of all, the guilty verdict is the first step toward justice being served. If Woodward did not want to be approached by a Gay man, he only needed to stay out of a Gay space. Period! We must not debate on whether Conservative judges or Liberal laws allow leniency on hate crimes. Unfortunately, there is a body of opinion that feels LGBT people should not be protected by hate crime laws and some people who demand a law and order harsh on crime agenda, and yet feel hate crime laws in general accord special rights to minority groups. We need to focus on ensuring hate crimes laws are enforced and that those who want to repeal hate crime laws or hate crime laws for LGBT people are not successful in their quest. BE PREPARED TO WRITE YOUR MP AND MLA TO DEMAND PROTECTION AND ENFORCEMENT OF HATE CRIME LAWS.
